And they made that clear back in, I guess, July 15th or July 18th.&#8221;<\/p>\n\n\n\n<p>It was on June 29<sup>th<\/sup>\u00a0that Justice Brett Kavanaugh said the Centers for Disease Control and Prevention had &#8220;<a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20a169_4f15.pdf\">exceeded its existing statutory authority<\/a>\u00a0by issuing a nationwide eviction moratorium.&#8221; He said Congress needed to legislate the moratorium.<\/p>\n\n\n\n<p>On Tuesday, President Biden said he&#8217;s conferred with constitutional scholars, and the &#8220;bulk&#8221; of them say the most recent CDC order is &#8220;not likely to pass constitutional muster.&#8221;<\/p>\n\n\n\n<p>&#8220;But,&#8221; he added, &#8220;there are several key scholars who think that it may and it\u2019s worth the effort.&#8221;<\/p>\n\n\n\n<p>So Biden asked the CDC &#8220;to go back and consider other options that may be available to them.\u201d<\/p>\n\n\n\n<p><strong>\u201cWhether that option will pass constitutional muster&#8230;I can\u2019t tell you,\u201d Biden said. \u201c I don\u2019t know.\u00a0 There are a few scholars who say it will and others who say it\u2019s not likely to.<\/strong><\/p>\n\n\n\n<p><strong>\u201cBut, at a minimum, by the time it gets litigated, it will probably give some additional time while we\u2019re getting that $45 billion out to people who are, in fact, behind in the rent and don\u2019t have the money.\u201d<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Biden told reporters at the White House on Tuesday: &#8220;Well, look, the courts made it clear that the existing moratorium was not constitutional; it wouldn\u2019t stand.
